Before court: conciliation, and how mediation can replace it
In most civil disputes you cannot go straight to court: art. 197 CPC requires a conciliation attempt before a cantonal authority first. Its name changes from canton to canton — juge de paix, juge de commune, commission de conciliation — because its organisation is a matter of cantonal law.
Art. 213 CPC allows that conciliation to be replaced by mediation if all parties request it — in the application, or at the hearing. Filing the application keeps its effects, and if the mediation fails, the authorisation to proceed is issued as soon as one party reports the failure. Once proceedings are open, art. 214 CPC still allows the court to recommend mediation.
